Верховна Рада прийняла у другому читанні та в цілому Закон про мінімальні запаси нафти та нафтопродукти (реєстр. №9024-д).
Закон визначає правові, організаційні та економічні засади створення та функціонування в Україні системи мінімальних запасів нафти та нафтопродуктів і регулює відносини у цій сфері.
Мета Закону - підвищити рівень енергетичної безпеки України та забезпечити безперервне постачання нафти та нафтопродуктів на внутрішній ринок України у разі виникнення кризової ситуації на ринку нафти та нафтопродуктів.
Ключові положення Закону:
- мінімальні запаси нафти і нафтопродуктів зберігаються у вигляді екстрених та спеціальних запасів, які не можуть використовуватися в комерційних цілях, а використовуються лише для подолання кризових явищ місцевого або глобального рівня;
- обсяг мінімальних запасів повинен відповідати, щонайменше, 90 дням середньодобового чистого імпорту або 61 дню середньодобового внутрішнього споживання, в залежності від того, яка з двох величин більша.
- передбачається система контролю, яка буде відстежувати обсяги, якість та місця розташування запасів.
Крім того, визначено функції та повноваження державних контролюючих органів, адміністратора системи репортингу, порядок фінансування функціонування системи мінімальних запасів нафти та нафтопродуктів, оновлено поняття кризової ситуації на ринку нафти та нафтопродуктів, її рівнів та встановлено чіткі повноваження Уряду та Міненерго; уточнено питання міжвідомчої координації та порядок створення, зберігання, заміни МЗНН тощо.
Прийняття Закону є обовʼязком України в часті імплементації нормативних документів ЄС.

The Parliament Adopted the Law on the Creation of Minimum Reserves of Oil and Petroleum Products
The Verkhovna Rada adopted in the second reading and as a whole the Law on the Creation of Minimum Reserves of Oil and Petroleum Products (reg. No. 9024-д).
The Law defines the legal, organizational and economic principles for the creation and operation of the system of minimum reserves of oil and petroleum products (MROPPs) in Ukraine and regulates relations in this area.
The purpose of the Law is to increase the level of energy security of Ukraine and to ensure a continuous supply of oil and petroleum products to the domestic market of Ukraine in the event of a crisis situation in the oil and petroleum products market.
The key provisions of the Law are as follows:
- the minimum reserves of oil and petroleum products are to be stored in the form of emergency and special reserves that may not be used for commercial purposes and will only be used to overcome crisis phenomena at the local or global level;
- the volume of minimum reserves must correspond to at least 90 days of average daily net imports or 61 days of average daily domestic consumption, whichever of the two quantities is greater;
- a control system is provided for, which will monitor the volumes, quality and locations of reserves.
Moreover, the Law defines the functions and powers of the state control bodies and of the reporting system administrator as well as the procedure for financing the operation of the system of minimum reserves of oil and petroleum products; updates the concept of a crisis situation on the oil and petroleum products market and its levels and clearly establishes the powers of the Government and the Ministry of Energy; and clarifies the issue of interdepartmental coordination and the procedure for the creation, storage and replacement of the MROPPs, etc.
The adoption of the Law is Ukraine’s commitment as regards the implementation of the EU regulations.
